How to get compliant with the Italian Whistleblowing Law
New whistleblowing laws based on the EU Whistleblowing Directive, require companies to implement internal reporting channels. The objective of whistleblowing laws is to enable employees to report cases of corruption and poor corporate practices in a secure manner, without fear of retaliation. From 17 December 2021, companies with more than 250 employees are obliged to implement a whistleblower solution. For companies with between 50 and 249 workers, the deadline is 17 December 2023.
Transparency and honesty within the workplace are values on the rise. They also contribute to a more positive and improved work environment. By implementing an online reporting system, organisations are facilitating the reporting of irregularities within the workplace. Since the information can be provided confidentially or anonymously, an internal whistleblowing channel is an excellent alternative for those who prefer the latter option.
Most people agree that blowing the whistle on wrongdoings is a moral and civic duty, and this includes the workplace. However, the fear of retaliation or being singled out as the company’s “snitch” is still present, and completely understandable.
To overcome the reluctance of potential whistleblowers, safe internal reporting channels are a particularly valuable tool. A method for reporting legal violations that ensures anonymity will of course encourage reporting. At the same time, simply the existence of this tool will act as a deterrent against dishonest or criminal acts in the business world.
When implementing a reporting channel, corporate best practices are clear: Designing a good implementation strategy is the key to success. Ideally, the company should choose and implement a whistleblower service or software that is efficient, intuitive and can guarantee the whistleblower anonymity and confidentiality. By law, companies must inform employees of internal reporting channels and provide training on how to use them efficiently.
As mentioned, companies with between 50 and 249 workers will have to comply with the provisions of the EU Whistleblowing Directive from December 2023. This includes both public and private organisations. Experts (and common sense!) advise companies not to wait until the last minute to comply with legal requirements. The reasoning behind this is simple: Organisations that are one step ahead will enjoy a greater capacity to adapt to the new situation. And this will benefit both your company and society as a whole.
