How to get compliant with the Whistleblowing Law

Misconceptions surrounding the use of whistleblower systems are often caused by a lack of understanding of the laws, processes, and protections afforded to whistleblowers. Many people may not be familiar with the reporting process and are not aware of the protection available to them

In this article, we will address five common misconceptions about the use of whistleblowing systems.

1. Whistleblowing systems are designed to encourage people to snitch on their colleagues.

Fact: This is a common misconception that implies that whistleblowers are betrayers. In reality, whistleblowing systems are created to enable employees to report any concerns or wrongdoings, without fear of retaliation.

2. Whistleblowing solutions are only for reporting misconduct or illegal activity.

Fact: While it is certainly important to have a way for employees to report misconduct or illegal activity, whistleblowing systems can also be used to report other types of concerns. This includes wrongdoings such as ethical violations, conflicts of interest, financial irregularities, or any other issue that may affect the company’s operations or reputation.

3. Whistleblowing systems are only for large corporations.

Fact: Whistleblower systems can be useful for organisations of any size, as they provide a structured and confidential way for employees to report concerns without fear of retaliation. Smaller organisations may not be obliged by the law to implement a whistleblowing system but can still benefit from establishing such procedures. The best practice would be to ensure employees can report their concerns to a designated HR representative or use an anonymous hotline or digital solution.

4. Whistleblowing systems are only used in certain industries.

Fact: While certain industries, such as finance and healthcare, may have more stringent regulations and oversight that require the use of whistleblowing systems, these systems are useful in any industry. Companies in all sectors will benefit from having a way for employees to report concerns in a confidential and structured manner. Furthermore, all companies in the European Union with more than 50 employees are required to implement secure reporting channels (the EU Whistleblowing Directive).

5. Whistleblowing systems are not effective.

Fact: When implemented properly, whistleblowing systems can be a valuable tool for addressing and resolving a variety of concerns within an organisation. Studies have shown that whistleblowers can play a critical role in uncovering and addressing misconduct or other problems. It has also proven that effective reporting channels can improve corporate culture and increase employee trust and engagement.

In conclusion, whistleblower systems can be a valuable tool for any organisation, regardless of size or industry. A secure system will help to improve corporate culture and increase employee trust by ensuring that any concerns can be reported in a safe and confidential manner.

When implemented properly, whistleblowing systems can be an effective way to ensure that concerns are reported internally and addressed in an appropriate manner.
